Terms of Service

1) Agreement

These Terms govern your access to and use of MissedCallHQ (“Service”). By using the Service, you agree to these Terms. If you use the Service on behalf of a business, you represent that you have authority to bind that business.

2) The Service

The Service may include call forwarding, missed-call detection, SMS delivery, lead capture, callback/booking links, routing to one or more phones, and basic logging. Some features depend on third-party providers and may be impacted by outages or filtering.

3) Transactional Messaging Only

The Service is designed for operational, service-related messages sent after a customer initiates contact with a business (e.g., missed-call follow-ups, callback confirmations, scheduling links).

No unsolicited marketing, promotions, cold outreach, or bulk SMS.

Opt-out: recipients can reply STOP.

Help: recipients can reply HELP.

Msg & data rates may apply. Message frequency varies based on customer interaction.

4) Your Responsibilities

Use the Service lawfully and in compliance with carrier rules and messaging policies. Ensure appropriate consent to message recipients. Provide accurate configuration (numbers, routing, hours, links, opt-out handling). Do not use the Service for harassment, deception, impersonation, spam, or illegal content. Maintain required disclosures on your website and communications.

5) Acceptable Use & Enforcement

We may suspend or terminate access for violations, suspected abuse, carrier policy issues, or to protect compliance.

6) Service Availability

The Service is provided “as is.” Delivery can be affected by carrier/network conditions and third-party systems.

7) Fees & Billing

Pricing, carrier fees, and taxes (if any) are provided during onboarding or in an order form. Non-payment may result in suspension.

8) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

9) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY IS LIMITED TO THE FEES PAID BY YOU FOR THE SERVICE IN THE 30 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10) Termination

You may stop using the Service at any time. We may suspend or terminate access for violations or non-payment.

11) Changes

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
